These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Buyer," or "Seller") and RealBids.co, operated by Birddog Marketing Co. LLC and licensed broker Ryan Pirkle ("Company," "we," "us," or "our"). By registering for an account, submitting a property, placing a bid, or otherwise using the RealBids.co platform, you confirm that you have read, understood, and agree to these Terms.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the platform after changes constitutes acceptance of the revised Terms.
RealBids.co is an online real estate auction marketplace that facilitates competitive bidding on real property located primarily in Georgia and South Carolina. The platform connects sellers who wish to sell real property through a competitive auction process with registered buyers who submit bids.
RealBids.co and its agents are licensed real estate professionals and auctioneers in Georgia and South Carolina. All transactions are conducted in compliance with applicable state licensing requirements.
You must be at least 18 years of age and legally capable of entering into binding contracts to use this platform. By using RealBids.co, you represent and warrant that you meet these requirements. We reserve the right to verify identity and eligibility and to deny access to any user at our discretion.
Entities (corporations, LLCs, trusts) may register; the individual completing registration confirms they have authority to bind the entity to these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to update it as needed. You may not share your account or transfer it to another party without our written consent.
We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in prohibited conduct.
All auctions conducted on RealBids.co are governed by auction-specific terms disclosed in each property listing. The following general rules apply to all auctions unless otherwise specified:
- All bids are legally binding commitments. By placing a bid, you agree to complete the purchase at that price if you are the winning bidder and the seller accepts.
- Bids may not be retracted once submitted, except as may be required by applicable law.
- The platform may automatically extend the auction closing time when bids are placed near the scheduled end time to prevent last-second "sniping."
- Reserve prices, if applicable, are confidential. The seller is not obligated to sell if bidding does not meet the reserve price.
- Absolute auctions (clearly labeled as such) have no reserve price and will sell to the highest bidder.
- Bid manipulation, shill bidding, and any attempt to artificially inflate or deflate prices are strictly prohibited and may result in account termination and legal action.
RealBids.co reserves the right to cancel, postpone, or modify any auction in its sole discretion, including for technical failures, suspected fraud, or legal requirements.
By registering to bid, you confirm that you have reviewed all available property disclosures, conducted or waived your own due diligence, and are prepared to close the transaction at your winning bid price plus any applicable buyer's premium. Buyers must:
- Complete buyer registration and provide any required documentation or deposit before bidding.
- Have financing or cash funds fully arranged prior to bidding — financing contingencies are generally not permitted in auction contracts.
- Execute a purchase contract within the timeframe specified in auction terms upon winning a bid.
- Proceed to closing within the timeframe specified, or forfeit any earnest money deposit and be subject to additional remedies.
A buyer's premium, if applicable, will be clearly disclosed in each listing and added to the winning bid to determine the total purchase price.
Sellers agree to provide accurate property information and disclosures to the best of their knowledge. Sellers must have legal authority to sell the subject property and must disclose any known liens, encumbrances, legal proceedings, or material defects. Sellers agree to cooperate with the closing process in a timely manner upon a qualifying winning bid.
Listing on RealBids.co is free. RealBids.co earns a commission payable by the seller upon a successful closing. The commission rate will be agreed upon in writing prior to the auction. Buyers may be subject to a buyer's premium as disclosed in each auction listing. All fees are negotiated and disclosed before any obligation is incurred.
Buyers are strongly encouraged to conduct independent inspections, title searches, and all applicable due diligence before placing any bid. The availability of inspection periods, if any, is disclosed per listing. By bidding, you acknowledge that you have had the opportunity to inspect and accept the property in its current condition.
RealBids.co is not responsible for any errors or omissions in property descriptions provided by sellers. Verify all property information independently.
To the maximum extent permitted by applicable law, RealBids.co, its officers, agents, and licensees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or participation in any auction, even if advised of the possibility of such damages.
RealBids.co's total liability to any user shall not exceed the total commissions actually received by RealBids.co in connection with the transaction giving rise to the claim.
These Terms shall be governed by the laws of the State of Georgia, without regard to conflict of law principles. Any dispute arising under or related to these Terms shall be resolved first through good-faith negotiation, and if unresolved, through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Georgia. You waive any right to a jury trial and agree that arbitration will be the sole dispute resolution mechanism.
Notwithstanding the above, either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
